Importer Compliance Self-Assessment

Importers are now held accountable for compliance with Customs requirements, and must show reasonable care in managing their import programs. The import community can achieve internal and Customs compliance goals by engaging in a program that assesses their overall compliance with Customs laws and regulations and evaluates their import policies and procedures.

S E L F - A S S E S S M E N T

An Importer Compliance Self-Assessment is an evaluation of the company's importing operations to determine the level of compliance with Customs laws and regulations. Tradewin® will review current importing practices by interviewing personnel in various departments within your company, and by reviewing representative Customs entries. Tradewin® will also review accounting systems and records, royalty and agency agreements and contracts to identify areas of possible non-compliance.

A detailed report consisting of the compliance requirements of U.S. Customs, the company's current import practices, observations and analyses on areas on non-compliance by Tradewin® and our recommendations to establish reasonable care will be prepared and presented to your company upon completion of the review. This will include an in-depth review of the four common importer checks (valuation, classification, record keeping, and quantity) as well as special trade programs (NAFTA, GSP, etc) as required and applicable to your business.

As part of the self-assessment process, Tradewin® will provide a general set of import procedures for the four common importer audit checks and procedures for any special trade areas. These procedures, as adapted to fit specific company business practices, will enable your company to achieve and maintain maximum compliance with Customs laws and regulations. They will also help you meet the standard of reasonable care as required by the MOD Act.

C O N C L U S I O N

The MOD Act has changed the way U.S. Customs enforces tariff and trade laws. Importers who wish to stay ahead of the curve and avoid import difficulties and penalties will need to gain a greater understanding of compliance issues that affect your core business. Tradewin® is available to help you understand the rules so that you may avoid costly delays, additional duties, and/or penalties and fines.
