Since December 1993, all trade-related activities initiated by the U.S. Customs Service ( now U.S. Customs & Border Protection (CBP) ) have been driven by the Customs Modernization Act (MOD Act). The MOD Act instituted the concept of U.S. Customs sharing responsibility with the importing community to achieve maximum compliance with U.S. import laws and regulations. The import community can achieve these goals by engaging in a program that assesses it's overall compliance with U.S. Customs laws and regulations and evaluates its import policies and procedures. The most prevalent compliance issue for U.S. Customs is incorrect tariff classifications that can result in increased duties and penalties as well as possible admissibility issues. The MOD Act places responsibility for accurate tariff classifications on the importing company and requires that importers use reasonable care in determining the tariff classification of imported goods. Importers can meet this standard of reasonable care by determining the correct Harmonized Tariff Schedule of the United States (HTSUS) code for all their imported products and developing a comprehensive tariff classification database which may be used for U.S. Customs clearance. This database may also be used to complete the Shipper's Export Declaration for exports from the U.S.

Among its many services, Tradewin® provides expert HTSUS classification review of imported goods. Our talented staff includes licensed customs brokers and experts in tariff classification from the private sector. Working with your company's product experts, Tradewin® will determine the function, form and composition of the product and using tariff classification principles, will determine the proper HTSUS code. To provide guidance on complex issues, Tradewin® will fully research all relevant binding classification rulings issued by U.S. Customs and will assist your company in obtaining rulings as needed. Tradewin® can also assist you in determining the country of origin that, in combination with the HTSUS classification, may allow you to take advantage of special trade programs such as GSP or NAFTA.

Tradewin® recommends that importers maintain visibility to and control of their product compliance information via a system. Tradeflow®'s Product Management Centre faciliates access control, allows information to be shared with Trade Partners, includes field-level change history, document images can be uploaded, and provides users with integrated access to tariffs for over 120 countries. Tradewin® customers have the option of subscribing to Tradeflow® to store the classification work and use the system to streamline entry processing. A web-view or data extract can be made available to Customs brokers.
